rear mud flap on rat loose

Riding down the road the other day my mudflap like cover started rubbing the back wheel on my rattler. I pullled over and noticed the two screws missing that normally hold it on the frame.

I had to take a similar size screw off the rear rack to fix it until I got home.

Well now that I have new screws, the back wheel tends to rub the flap from time to time while riding. Its started to eat away at the plastic. Can this be adjusted or any other ways I can fix this? I couldnt figure out if its the flap that needs to be raised (cant go any higher) or the rear shock/tire need to be adjusted. Pic included..

Suggestions?

good luck i ended up just taking the fender off all together after welding it and it braking again... the last time it fell on the tire and rubbed till the plastic start to melt and then it stopped the bike from the friction...

Yup, just about tire time. I kept a little piece of the fender to protect the carb from any large debris getting thrown onto it. Otherwise it would all be gone.
